01Who we are

JRD Dance Media Pty Ltd (ABN 93 682 870 711), referred to in these terms as JRD Dance Media, we or us, is a dance photography and videography business based on the Central Coast of New South Wales. We photograph and film dance competitions, concerts, festivals, events, school photo days and private sessions, and we sell and deliver the results online.

These terms apply whenever you buy from us, redeem a download code, book us, or use one of our services. Where a particular page or invoice adds its own conditions, those apply alongside these terms. If you have a question about anything here, email accounts@jrddancemedia.com.

02Copyright and ownership

What you receive is a licence, described in the next section. It lets you use the content in the ways set out there and no further.

03Your licence to use our work

Clients who book us

When a studio, school, festival, competition or other organiser (the client) books us and pays in full, the client receives a non-exclusive, non-transferable licence to use the delivered media for its own promotion, teaching and internal purposes. The client may pass access on to its own dancers and families, who then hold the family licence below. The client may not sell, sub-license or distribute the media to anyone else.

Families and dancers

Whether you buy from our store, redeem a code from your school, or book a private or promo shoot, you receive a personal, non-commercial licence to download, keep, print and share your own dancer's photos and videos. We are glad for you to post them on social media; please credit @jrddancemedia when you do.

What no licence allows

• Selling, sub-licensing or supplying the files to anyone else, or using them in advertising, for a business or for any commercial purpose, without our written permission.
• Sharing a download link, download code or purchased file with people outside your own family.
• Removing watermarks or credits, or presenting our work as your own.
• Using images of other people's children in any way beyond the private, family use they were provided for.

Use outside a licence is copyright infringement. Where it happens we may cancel access and rely on the remedies available under the Copyright Act 1968.

04Competition photo & video store

After a competition we photograph and film, each dancer's photos and videos appear in our online store. Please allow up to 72 hours after each event for an album to appear.

• Prices. All prices are in Australian dollars and include GST. Volume discounts, where offered, apply automatically in the cart.
• Payment. Payment is taken securely by Stripe. We do not see or store your card details.
• Delivery. After payment you receive an email with a secure download link. Photos are supplied as a ZIP file and videos as individual downloads.
• Download period. The link is valid for 30 days. After that the content needs to be purchased again, so please download and back up your files promptly.
• Social Media Version. Where offered, this optional add-on is a vertical crop of a competition video, produced with automated tracking and checked by us. It is a derived version of the original video and is covered by the same licence.
• Acceptance. Proceeding to checkout confirms that you accept these terms.

Refunds for store purchases are explained in section 12.

05Concert and photo-day downloads

When a studio or school engages us for a concert, event or photo day, families usually receive their photos and videos free of charge through a download code issued by the studio or school.

• Codes. Each code is issued to one family, is single use, and is tied to the email address used to redeem it.
• Email check. Before anything downloads, the download page asks for the email address the code was issued to. After five incorrect attempts the link pauses for an hour.
• Download limits. Each file, and the photo ZIP, can be downloaded twice. Download links are valid for 14 days. If you need a fresh link, ask your studio or school to request one.
• Download records. Every download is recorded against the email address, the time and the internet address it came from, so a shared link or file can be traced back to the family it was issued to.
• Removal. A studio or school can ask us to remove its album, or an individual dancer, by emailing accounts@jrddancemedia.com.

Concert and photo-day files are for your family only. They contain other families' children, which is why the sharing rules in section 3 matter here most of all.

06Bookings: concerts, events, festivals, competitions and photo days

These terms apply to every booking we accept from a studio, school, festival, competition or other event organiser, whether it begins with a quote, an enquiry form or a conversation.

• Quotes and invoices. A quote becomes a booking when we issue an invoice and the deposit is paid. All prices include GST.
• Deposit. A 25% deposit secures your date and is a holding deposit. If you cancel more than 12 weeks before the event, the deposit may be refunded in full or in part; this is decided case by case. Within 12 weeks of the event the deposit is non-refundable, as the date is unlikely to be rebooked.
• Balance. The balance is due 7 days before the event. We send payment reminders by email ahead of the due date.
• Changes. If the event date, venue or running time changes, tell us as early as you can. We will do our best to accommodate the change; where we cannot, the deposit terms above apply.
• On the day. We need safe access to the venue, a suitable position for cameras, and power where arranged. Lighting, sound and staging remain the organiser's responsibility; we work with what the venue provides.
• Delivery. Competition photos and videos are delivered to families through our online store. Concert, event and photo-day files are delivered to the client, or to families through download codes, as agreed in the booking.
• Licence. On payment in full the client receives the licence described in section 3. Ownership stays with JRD Dance Media under section 2.
• Acceptance. Paying the deposit or the balance confirms the client accepts these terms.

07Private shoots

Private photo and video sessions are booked through our website.

• Deposit. Your 50% deposit confirms your booking once we reply to confirm the date. The balance is payable as set out on your booking.
• Cancellation. Cancel 7 or more days before the shoot for a full refund of the deposit. Cancellations within 7 days forfeit the deposit.
• Rescheduling. We reschedule free of charge with 72 hours' notice or more.
• Travel. Where we travel to you, travel is charged by distance from Tuggerah, NSW, as shown on the booking page.
• Delivery. Standard edit turnaround is 2 weeks from shoot day.
• Copyright. JRD Dance Media owns the copyright in every photo and video from your shoot. Your booking gives you the family licence in section 3.

08Promo shoots

Promo shoots are short, heavily discounted studio sessions. Because of the discount, their conditions are firmer than a private shoot.

• No refunds, cancellations or changes. Please be sure of your date and time before you pay.
• Payment is the booking. Your slot is confirmed only once payment is complete. Unpaid slots are released after 15 minutes.
• Arrive shoot-ready. Hair and make-up done, 10 minutes early. Your session starts at the booked time; a late start does not extend it. Two outfits maximum, and changing uses your time.
• One dancer per booking. Siblings and duos each need their own slot.
• What you receive. Every photo taken, with five professionally edited, chosen by our team. Extra edits are $35 per photo. Photos arrive within 28 days as a private download link.
• Promotional use. JRD Dance Media may use promo shoot images in its own advertising and social media. You can opt out on the booking form.
• On the premises. A parent or guardian must stay for the whole session. No eating anywhere in the studio, and please be courteous to everyone in the waiting area.

09Auto Tracker

Auto Tracker turns a stage-wide video of a solo into a vertical clip that follows the dancer. It costs $10 per video including GST, works for solo performances only, and the finished clip is emailed as a download link, usually within the hour.

You must own or have permission to use the video you upload. Auto Tracker has its own terms, which apply together with these: Auto Tracker Terms.

10Children and appropriate use

Almost everything we photograph and film involves children. We take that seriously, and we ask the same of everyone who uses our services.

• Our store and download pages are for parents, guardians, family members, teachers, choreographers, studio owners and adult dancers. By continuing into them you confirm you are one of these people.
• Content is for private, family use only. It is never to be used for any purpose that could exploit, embarrass or endanger a child.
• Visits to our store and every download are logged, and records are kept for child protection and security purposes.
• If a parent or guardian would prefer their dancer not to appear in our online store or galleries, email accounts@jrddancemedia.com and we will remove them.

11Privacy

We collect only what we need to deliver our services, and we handle personal information in line with the Australian Privacy Principles.

What we collect

• Names, email addresses and phone numbers given when you buy, redeem a code, book or enquire.
• Dancers' names and studios as they appear in competition programs, concert running sheets or booking forms, so that photos and videos can be matched to the right dancer.
• Order, invoice and booking details, and records of download activity, including the time and internet address of each download.

How we use it

To deliver your files, process payments, send order and booking emails, answer enquiries, keep our systems secure and meet our obligations around child safety. We send marketing only to people who have asked for it, and every such email includes an unsubscribe link.

Who else handles it

Payments are processed by Stripe. Emails are sent through Resend. Files are stored and delivered using Dropbox and Cloudflare. Our website runs on Squarespace and our store systems on Railway. Each of these providers holds the data needed for its part of the job under its own privacy terms. We do not sell personal information.

Your choices

You can ask to see, correct or delete the personal information we hold about you, or ask for a dancer's images to be removed, by emailing accounts@jrddancemedia.com. Some records, such as invoices, must be kept for the period the law requires.

12Refunds and Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those guarantees.

• Digital purchases. Because photos and videos are delivered immediately as digital files, we do not refund change of mind, including choosing the wrong dancer or routine, so please check your cart before you pay. If a file is faulty, missing or cannot be downloaded, email us and we will replace it or refund it as the law requires.
• Bookings and shoots. Deposits and cancellations follow the conditions in sections 6, 7 and 8.
• How to ask. Email accounts@jrddancemedia.com with your order number or booking details and we will respond promptly.

13Changes and contact

We may update these terms from time to time. The version on this page is the current one, and the date at the top tells you when it last changed. Changes apply to purchases, bookings and downloads made after that date; a booking already confirmed keeps the terms it was made under.

These terms are governed by the laws of New South Wales, Australia.
